CANCELLATION, RETURNS, AND REFUND POLICY
1. PERIOD FOR EXERCISING THE RIGHT OF WITHDRAWAL:
The Customer has the right to withdraw from the purchase of our products within a period of 14 calendar days without the need for justification.
The withdrawal period will end 14 calendar days from the receipt of the products by the Customer.
Likewise, we want to emphasize the need to report any visible defects in your order at the moment of receipt and to record them on the delivery note in a reliable manner. We also take this opportunity to point out that any missing units of items that occur at the time of receiving your purchase must be reported to us at our contact email info@baratonexpress.es within a maximum of 24 hours from the delivery of the order.
To exercise the right of withdrawal, the Client must notify us (including their full address, phone number, fax number, and email address) of their decision to withdraw from the contract through a clear statement (certified letter, fax, or email).
To meet the withdrawal deadline, it is sufficient for the communication regarding the exercise of this right to be sent before the corresponding period expires.
In any case, for the purposes of exercising the right of withdrawal, it is necessary that the product be returned in its original packaging (including bags, boxes, user manuals, etc.) along with the invoice and all its components; otherwise, the return of the product may be rejected and/or an additional fee may be applied for any depreciation the product has suffered. Before returning the product, the Customer must ensure that it is properly protected and sealed so that it does not get damaged during transport.
The Customer will be responsible for any decrease in the value of the product resulting from handling that is different from what is necessary due to its nature, characteristics, or functioning.
Notwithstanding all the foregoing, the right of withdrawal and/or termination is excluded in cases where, due to the very nature of the goods being acquired, it is impossible to carry it out.
2. WITHDRAWAL: RETURNS AND REFUND
In the event of withdrawal by the Customer, we will only refund the amount paid for the price of the purchased product and delivery to their home. The Customer must pay the cost of transportation to our facilities, which will be informed at the time of purchase, as well as the dismantling and re-packaging of the purchased goods, and any additional services contracted by the Customer in relation to the order, which have already been fully carried out and/or provided by our employees.
Likewise, in the event of withdrawal by the Customer within 14 days, the direct cost of returning the good and/or service will be borne by the Customer as provided in the LGCU; the direct costs of returning the good will in any case include expenses for transportation, collection, and shipping of the product, as well as the dismantling service.
To proceed with the return, the product must be in the same condition in which it was delivered and must retain its original packaging and labeling, using the same protective cardboard box in which it was received to protect the product.
The product must not have been used beyond checking it. It cannot have been altered and must retain all its accessories and instructions for use.
If the Customer exercises the right of withdrawal within the established period and wants to return a product because it does not meet their expectations, they can return it through one of our delivery vehicles, and we will handle all the necessary arrangements. We will always inform you of the exact cost before accepting the return of the product. These return costs will be deducted and offset from the total amount to be refunded for the purchased product.
Once the merchandise is received in our warehouses and its condition has been checked, the refund will be processed according to the payment method used by the customer, except for cash payments, which will be refunded via bank transfer and, in any case, within a maximum period of 14 calendar days from the receipt of the returned merchandise in our warehouses.
Nevertheless, notwithstanding all of the above, the right of withdrawal and/or termination of the contract is excluded in relation to:
– Products configured or custom-made at the customer's request, unless due to manufacturing or shipping defects.
–The provision of services, once the service has been fully performed, when the execution has begun, with the prior express consent of the consumer and user and with their acknowledgment that they are aware that, once the contract has been fully performed by the business, they will have lost their right of withdrawal.
– For reasons of hygiene and/or health, the return of sleep products (mattresses, pillows, etc.) will not be accepted if they have been unsealed, except for those that have manufacturing defects.
– Those cases in which, due to the very nature of the goods purchased, it is impossible to carry out the return.
– Returns of furniture that have already been assembled by the Customer will also not be accepted.
To exercise the right of withdrawal, the Customer must notify us (including their full address, telephone number, fax number, and email address) of their decision to withdraw from the contract through an unequivocal statement (registered letter, fax, or email).
In the event of withdrawal by the Customer within 14 days (counting from the day of receipt), the direct cost of returning the good and/or service will be borne by the Customer as established in the LGCU, Royal Legislative Decree 1/2007; the direct costs of returning the good will in any case include transportation to our facilities, re-packaging and collection expenses, as well as the disassembly service.
3. PRODUCTO DAÑADO DURANTE EL ENVÍO O DEFECTUOSO, GARANT, GARANTÍAS.
If you return a product due to an error on our part, that is, a damaged, deteriorated, defective product, or a shipping error, we will always cover all return costs, and the pickup will be carried out at no charge to the Customer. In all other cases, the customer will bear all return costs.
For returns due to a damaged or defective product, the defect or damage must first be verified by sending photos so we can check that the item is indeed damaged or deteriorated. From that point on, everything will be covered by us:
All furniture and its parts come with a 3-year warranty, provided the Customer acts as a Consumer.
We take care of all necessary expenses for the repair, replacement, or refund of the amount as appropriate, with all these procedures being free of charge for the consumer.
BaratonExpress.es will respond to claims due to non-conformities that arise within 6 months of delivery, provided that the consumer has notified such non-conformity within two months from the time they became aware of it.
The warranty for the furniture and all its parts covers all manufacturing defects, but not those caused by misuse or improper cleaning. Do not forget to keep the email that shows the purchase date of the product.
